Home Care Direct Pgh LLC operates in full compliance with Pennsylvania Chapter 611 regulations governing non-medical home care agencies, as well as all applicable federal and state civil rights laws.

Our Commitment to Compliance

Home Care Direct Pgh LLC is fully licensed by the Pennsylvania Department of Health as a non-medical home care agency under Title 28, Chapter 611. We are committed to maintaining full compliance with all applicable regulations to ensure the safety, dignity, and well-being of every consumer we serve. The standards below reflect our operational practices as required by Pennsylvania law.

Non-Medical Home Care Provider: Home Care Direct Pgh LLC provides non-medical home care services only. We do not provide skilled nursing, medical therapy, wound care, or any Medicare home health services. For medical needs, please contact your physician or a licensed medical home health agency.

Pennsylvania Chapter 611 Compliance

Title 28, Health and Safety — Home Care Agencies and Home Care Registries

§ 611.2 — License Required

Chapter 611
  • Home Care Direct Pgh LLC operates under a license issued by the Pennsylvania Department of Health in accordance with Chapter 611 of Title 28 (Health and Safety).
  • No entity may operate as a home care agency without first obtaining a license from the Department. Each physical location must be separately licensed.
  • The Department conducts an inspection prior to issuing an initial license or a license renewal.
  • License renewal applications are submitted at least 60 days prior to expiration, along with the required $100 fee.
  • Our license specifies that we operate as a home care agency providing non-medical home care services.

§ 611.3 — Scope of Services (Non-Medical)

Chapter 611
  • Home Care Direct Pgh LLC is a home care agency as defined under Chapter 611 — we supply, arrange, and schedule employees to provide home care services in the consumer's place of residence.
  • We provide non-medical home care services only. This chapter does not apply to home health care agencies, durable medical equipment providers, or Medicare home health services.
  • Our services include: Personal Care, Assistance with Instrumental Activities of Daily Living (IADLs), Companionship Services, Respite Care, and Specialized Care.
  • We do not provide skilled nursing, medical therapy, wound care, or any Medicare-covered home health services.

§ 611.4 — Operational Requirements

  • A current copy of Chapter 611 is maintained at our agency at all times.
  • We comply with Chapter 51 (General Information) applicable to all entities licensed as health care facilities under the Act.
  • We comply with all applicable environmental, health, sanitation, and professional licensure standards required by Federal, State, and local authorities.
  • Where differences exist between State and local standards, the standards established under State statutes apply for compliance purposes.

§ 611.51 — Hiring of Direct Care Workers

  • Prior to hiring any direct care worker, we conduct a face-to-face interview with the individual.
  • We obtain at least two satisfactory, verifiable references from former employers or other non-related persons that affirm the individual's ability to provide home care services.
  • All applicants are required to submit a criminal history report and, where applicable, a ChildLine verification prior to employment.
  • Direct care worker files include documentation of the face-to-face interview date, references obtained, criminal history records, and all other required documentation.

§ 611.52 — Criminal Background Checks

Chapter 611
  • All applicants for employment as direct care workers, office staff, and agency owners are required to obtain a criminal history report.
  • PA residents of 2+ years obtain a State Police criminal history record. Non-PA residents or those residing in PA less than 2 years obtain a Federal criminal history record and a Department of Aging letter of determination.
  • We do not hire, roster, or retain any individual whose criminal history reveals a prohibited conviction as listed in 6 Pa. Code § 15.143.
  • All criminal history records are kept strictly confidential and used solely to determine an applicant's eligibility for employment.
  • Individuals not hired based on criminal history are provided an opportunity to appeal the decision.
  • All criminal history records are maintained on file and available for Department inspection.

§ 611.54 — Provisional Hiring

  • A direct care worker may be hired on a provisional basis pending receipt of criminal history and ChildLine clearances, provided all application forms have been submitted.
  • Provisionally hired workers are monitored through random direct observation and consumer feedback, documented in their file.
  • The provisional hire period may not exceed 30 days for PA residents of 2+ years, or 90 days for others.
  • Provisionally hired workers may not be assigned until competency requirements are met.
  • If criminal history or ChildLine verification reveals disqualifying information, the individual is terminated immediately.

§ 611.55 — Competency Requirements

Chapter 611
  • Prior to assignment, all direct care workers must demonstrate competency by passing our agency's competency examination or completing an approved training program.
  • Training covers: Confidentiality, Consumer Control, IADLs, Recognizing Changes in Consumer Condition, Basic Infection Control, Universal Precautions, Emergency Handling, Documentation, Recognizing and Reporting Abuse or Neglect, and Dealing with Difficult Behaviors.
  • Workers providing personal care receive additional training in: Bathing, Shaving, Grooming, Dressing, Hair/Skin/Mouth Care, Ambulation and Transfers, Meal Preparation, Toileting, and Assistance with Self-Administered Medications.
  • Competency is reviewed at least once per year through direct observation, testing, training, or consumer feedback.
  • Documentation of competency completion is maintained in each direct care worker's file.

§ 611.56 — Health Screening

Chapter 611
  • All direct care workers and office staff with direct consumer contact must provide documentation of tuberculosis (TB) screening prior to consumer contact.
  • TB screening is conducted in accordance with CDC guidelines for preventing the transmission of mycobacterium tuberculosis in health care settings.
  • Documentation must indicate the screening date, which may not be more than 1 year prior to the individual's start date.
  • TB screening documentation is updated at least every 12 months and maintained in each individual's file.

§ 611.57 — Consumer Protections

Chapter 611
  • Consumers have the right to be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences.
  • Consumers receive at least 10 calendar days advance written notice of intent to terminate services (exceptions apply for non-payment after 14+ days in arrears or risk to caregiver health/welfare).
  • No caregiver or agency representative may assume power of attorney or guardianship over a consumer. Consumers may not be required to endorse checks to the agency.
  • Prior to service commencement, consumers receive a written information packet including: available services, service hours, fees and total costs, Department of Health contact information, the Department's complaint hotline (1-800-254-5164), and the local Area Agency on Aging (AAA) Ombudsman number.
  • Consumers are also provided a disclosure of the direct care worker's employment status (employee vs. independent contractor) and the resultant tax and insurance obligations.

Consumer Rights Summary

Under § 611.57, every consumer of Home Care Direct Pgh LLC services has the following rights:

Involvement in your own service planning process
Reasonable accommodation of individual needs and preferences
At least 10 days advance written notice before service termination
A written information packet before services begin
Knowledge of caregiver identity and scheduled service hours
Clear disclosure of all fees and total costs
Access to the PA Dept. of Health complaint hotline: 1-800-254-5164
Contact information for the local Area Agency on Aging (AAA) Ombudsman

Documentation & Record Keeping

  • All required records — including criminal background checks, competency documentation, health screenings, consumer information packets, and service agreements — are maintained on file at the agency.
  • Records are available for inspection by the Pennsylvania Department of Health upon request.
  • Signed acknowledgment forms, training attendance sheets, distribution logs, and website posting dates are maintained as required.
